Defining How Land is Used

Redesingation is often referred to as rezoning. In Mountain View County’s Land Use Bylaw, the County is divided into different land use districts or zones. Each district has its own designated uses and defines what subdivisions may be permitted within it.

Depending on what you’d like to do with a property, it may be necessary to change the property’s zoning or designation to another district. When this occurs, it is called, redesignation.


What you need to know
  • Timing: It takes about 2 months to process a redesignation application. Complex applications may take longer.

  • Public Hearing: If your application is accepted, County Council will hold a public hearing on your application. Your neighbors will be notified by mail of your application and the public hearing. Please speak to your neighbors early on – their views are important and they may speak to Council at the hearing.
    As well, your application will be circulated to utility companies and government departments who may submit comments and speak at your public hearing.

  • Council Decision: Decisions on redesignations are made by Council. Planning staff can advise you on the guidelines, but final decisions are made at the Council table.

  • First Step Only: Redesignation is only one step in the process to subdivide or develop. Once you achieve redesignation, you will need to apply to subdivide, and/or to develop.

  • Applications: A completed application for redesignation includes a completed form (which can be obtained from the Planning Department (403-335-3311); an application fee (amount is indicated on the fee schedule); a detailed sketch showing your proposed redesignation; a current title (issued in the last 30 days); permission to enter your property and any other supporting information. Subdividing Land

The Municipal Government Act
Subdividing land comes under the Alberta Municipal Government Act. In Mountain View County, the Municipal Planning Commission is the subdivision approval authority.

What you need to know

  • Timing: Applications for subdivision can be fairly lengthy, therefore it is important to allow adequate time for the review process. It can take up to 60 days for a decision which may or may not result in an approval. You will be advised in writing of the decision with either a letter of conditional approval (it can take up to one year to fulfill the conditions outlined) or a letter of refusal.

  • Application: A completed application for subdivision includes a completed form (which can be obtained from the Planning Department (403-335-3311); an application fee (amount is indicated on the form); a detailed sketch showing your proposed redesignation; a current title (issued in the last 30 days) and permission to enter your property. The Planning Department staff will be pleased to help you address any application questions or concerns.

  • Process: Once we receive a completed application, we will circulate it to your neighbours, utility companies, relevant government departments and others who may be impacted. We will visit your property and then take your application to the Municipal Planning Commission for review and conditional approval. A decision will be sent to you in writing within 60 days of your completed application.

  • Appeals: If you not happy with the decision, you may appeal to either the Municipal Government Board or the County’s Subdivision and Development Appeal Board. There is a fee to appeal.

  • Conditional Approval: Once you have a received a conditional approval, you have one year to meet all conditions. If you require more time, please request an extension (there is a fee for this). Meeting all conditions is the responsibility of the applicant.

    As part of the conditions, you will need to contact a surveyor. When all conditions have been met, final documents (as prepared by a surveyor) will be signed off by the Planning Department and registered in Calgary at the Land Titles Office. The Land Titles office will issue you new titles for your property.

Terms and Conditions
  • All applications must be completed in their entirety. Please put a n/a in spaces which are not applicable to the application.
  • All applicant and landowner signatures within the file must be original signatures. If a corporation owns the parcel, documentation must be submitted indicating those who have signing authority under seal.
  • A legible site sketch or Real Property Report must be submitted with applications.
  • A current copy (obtained within 30 days of application) of the Certificate of Title must be submitted. These can be obtained from you local registry office.
  • Fees must be submitted with application. Please refer to fee schedule.
