Notice of Public Hearing - Bylaw No. LU 96/10 and Bylaw No. 19/10 - Sept. 16, 2010

Please be advised that a public hearing on the above bylaws shall be held on Thursday, September 16, 2010 at 9:00 am.

The public hearing will be held at the following address:

Bylaw No. LU 96/10 proposes the redesignation of 22.29 +/- acres from Country Residential District - 'R-CR' to Country Residential 2 District - 'R-CR2'. The purpose of this redesignation is for the subdivision of twelve (12) 1.0 +/- acre parcels, and one (1) 7.07 acre Private Open Space parcel. Click here to view Bylaw No. LU 96/10 and Schedule A.

Bylaw No. 19/10 proposes the adoption of a concept plan in accordance with Section 653(4.4)(b) of the Municipal Government Act.   • Pt. NE 34-29-05-W5 - Plan 9611711, Lot 7, C. of T. #031 152 348, 4.55 acres

Each parcel will be offered for sale subject to a reserve bid and to the reservations and conditions contained in the existing certifi cate of title.

If you are a Mountain View County Ratepayer and you need gravel this year, there will be a loader available at no charge at the following County gravel pits from 7 a.m. to 4:30 p.m. on the following dates:

Mountain View County taxes are due on or before September 15, 2010

Please be reminded that Mountain View County taxes are due on or before September 15, 2010. The County offers five payment options which provide flexibility and choice, making tax payment easier than ever:

1. On-line through your Financial Institution's electronic banking service.
2. Via the phone through your Financial Institution's tele-banking service.
3. Through the mail (Payments must be postmarked September 15, 2010 or earlier).
4. In person at the County Office during regular business hours.
5. After regular business hours at the County Office by using our new drop-off box.

While the application deadline has passed for the 2010 monthly payment program, you can register for the 2011 program anytime up until mid-January 2011. Call the County Office at 403-335-3311; or visit us on-line at www.mountainviewcounty.com for details on all tax payment options.

If you purchased property after the June, 2010 Tax Assessment Notices were mailed or did not receive your notice, please contact the Tax Administrator regarding outstanding property taxes.

Penalties will be applied to tax balances still outstanding after September 15, 2010

SE Sundre Area Structure Plan Revisions - Request for Proposals

Wessex Area Structure Plan Issues Identification Public Meeting

You are invited to an Issues Identification Public Meeting being hosted by McElhanney Consulting in conjunction with Mountain View County on:

Tuesday, August 31, 2010 at the Carstairs and District Community Hall (1100 Lackner Way, Carstairs)

6:00 -7:00 p.m. - Drop in and review materials
7:00 p.m. - Formal presentation, question and answer session

The Issues Identification Public Meeting is the first public session in the Area Structure Plan (ASP) process and is intended to inform residents of the process, project schedule and key dates for their involvement leading to the preparation of the ASP. This session will be an informal, relaxed and friendly event. The purpose of the meeting is to also hear from residents on positive and negative issues which the Plan area is facing as the ASP process gets underway.

Please come out and help plan your community for yourselves and future generations!!

A public survey and comment sheet will be distributed at this meeting. Please also follow us online (http://www.mountainviewcounty.com/asp) to monitor the process and to participate in any surveys and questionnaires if you are unable to attend any of the public sessions.

Administrative, planning and governance processes commended, suggestions made for improvement

An independent corporate review of Mountain View County reflects positively on the administrative, planning and governance processes of the organization, while identifying areas of improvement for the future. On the evening of Wednesday, July 14, representatives from Meyers Norris Penny LLP presented the results of the Independent Review of issues raised by petitioners in 2009 for the first time to both the public, and Mountain View County Council and staff. The presentation, which took place at Olds College, brought forward a number of recommendations and identified potential areas of improvement

Reeve Al Kemmere thanks Meyers Norris Penny LLP for their presentation, which he describes as thorough and insightful. "We believe this to be an accurate portrayal of the state-of-affairs at Mountain View County," Kemmere added.

Reeve Kemmere encourages every taxpayer and resident to have a voice in the democratic process, re-iterating that Council invited the public to provide their input throughout the review. "Public input is important to both Council and our staff. Council has listened to the feedback we've received, and this dialogue has helped to resolve the many allegations that have been brought forward." added Reeve Kemmere. "It's my position that Council needs to invest its time with groups or individuals who provide constructive input and give positive suggestions on ways to improve our services."

Mountain View County will be carefully reviewing this presentation and the full report and will respond quickly to implement improvements. So far, Mountain View County has invested over $125,000 to resolve these issues through this process.

Executive Summary: Findings of the MNP Review

Meyers Norris Penny LLP ("MNP") was engaged by Mountain View County Council to conduct an independent review of the issues raised by petitioners from September to December 2009. During 2009, the Rural Roots Association ("RRA") conducted six petitions concerning the County's Administration and bylaws. In addition, MNP reviewed management practices and made recommendations for improvement.. The observations and findings of MNP's review are in direct response to the request by Mountain View County. We have conducted our work in an unbiased manner and are independent of any party to this matter.

Key Findings:

1. There is no evidence that any illegal or inappropriate actions were taken by the Council, CAO and County Administration, or the Operational Services and Planning and Development

2. A review of legislation indicates that Mountain View County acted in accordance with the Municipal Government Act in developing their Municipal Development Plan, Land Use Bylaw, and Offsite Levy Bylaw.

3. The main issue between Mountain View County and its citizens appears to be a matter of communication. Citizens require explanation about Mountain View County's decisions and actions, in context of why they are undertaken, in a manner that is understandable.

4. The petitions created by the RRA were not in accordance with the Municipal Government Act. Under the Act, petitions cannot be created against land use bylaws, and must be submitted to the CAO of the municipality for verification. The RRA petitions did not meet the legislative criteria.

5. The RRA has effectively engaged the public and created dialogue regarding issues surrounding the Land Use Bylaw and other matters central to municipal administration. Although at times their tactics are provocative, they have created awareness of issues, affecting all residents.

6. The RRA's primary concerns are with the size of the municipal government and protection of individual landholders' development rights. Some of the RRA's concerns appear to be motivated by personal reasons. The RRA and Mountain View County agree that protection of rural and agriculture heritage and lifestyle are paramount to residents of the County.

7. In an independent public opinion survey, taxpayers are generally satisfied with the services of the County. However, they are concerned the new Land Use Bylaw and the Offsite Levy Bylaw may not be in their best interest. Taxpayers do not understand the rationale and purpose of the new bylaws.

8. Management practices are generally satisfactory within County Administration but some areas can be improved, most notably the development and monitoring of measurable improvement goals.

Key Recommendations:

1. Develop an internal communication strategy within the municipality to engage the public and explain the rationale for decisions made by Council and resulting changes to the operations of the Administration.

2. Develop a process for receiving and responding to various types of public enquiries, complaints and critical incidents, and measure and track complaints to gauge satisfaction and improvements.

3. Re-engage the public with consultation about the Municipal Development Plan and explanation of Council's vision for the future of the County that is represented in the plan.

4. RRA members should volunteer to assist Mountain View County with community consultation and feedback, as members of a community consultation committee.

5. County Administration should develop performance measures for each department, and track activity against these metrics to monitor financial and operational results.
